These Terms and Conditions govern your access to and use of our customer relationship management and multi-channel communication platform. By creating an account or using our services, you agree to be bound by these terms in their entirety. Please read these terms carefully before using the platform. Your continued use constitutes acceptance of any modifications we may make from time to time.
I. General Terms
Our platform provides tools and infrastructure for managing customer communications, contact databases, messaging campaigns, and related business functions across various channels and integrations.
A. Definitions and Service Description
- Services: The platform, software, features, integrations, APIs, and related functionality we make available to you, which may be modified, updated, or discontinued at our discretion.
- User Content: Any data, information, messages, contacts, files, or other materials you upload, transmit, store, or process through our services.
- Third-Party Platforms: External messaging services, communication channels, and integrations that you may connect to your account, each governed by their respective terms and policies.
- Account: Your registered user profile and any associated business entities, team members, subscriptions, and configurations.
- Subscription: Your selected plan level, which determines feature access, usage limits, and billing obligations.
- Communications: Messages, broadcasts, campaigns, and other interactions facilitated through our platform across integrated channels.
- Processing: Any operation performed on your data, including collection, storage, analysis, transmission, modification, or deletion.
B. Subscription Plans, Fees, and Payments
Subscription fees are determined by your selected plan and billing cycle. Additional charges may apply for usage-based features, including but not limited to AI-powered services, which operate on a pay-as-you-go basis with separate wallet funding.
Payment must be submitted according to the methods and procedures specified in the platform. We reserve the right to review and approve payment requests before activating or renewing licenses.
Fees are non-refundable except as required by law. Plan changes, feature modifications, or service interruptions do not entitle you to refunds or credits unless we determine otherwise at our sole discretion.
You are responsible for maintaining sufficient account balance for usage-based features. Services may be automatically suspended when balances are insufficient.
We may modify pricing, plans, or features at any time with or without notice. Continued use after such changes constitutes acceptance.
C. User Representations, Warranties, and Responsibilities
By using our services, you represent, warrant, and agree that:
- You have obtained all necessary rights, permissions, and consents to collect, store, process, and transmit any data you provide to our platform, including contact information and message content.
- You are solely responsible for compliance with all applicable laws, regulations, and third-party terms of service governing your use of messaging platforms, bulk communications, marketing activities, and data processing.
- You will not use the services for any unlawful, abusive, harassing, or unauthorized purposes, including but not limited to spam, fraud, or violations of third-party platform policies.
- You acknowledge that third-party messaging platforms maintain their own terms of service, acceptable use policies, and enforcement mechanisms, which may result in limitations, restrictions, or termination of your access to those platforms.
- You understand that our services facilitate communication through various channels but do not guarantee delivery, acceptance, or compliance with any third-party platform requirements.
- You are responsible for backing up your data and maintaining copies of any critical information, as we do not guarantee data preservation or recovery.
- You will maintain the security of your account credentials and are responsible for all activities conducted under your account.
D. Platform Integrations and Third-Party Services
Our platform integrates with third-party services to facilitate multi-channel communication. You acknowledge and agree that:
- Each third-party platform operates under its own terms of service, privacy policies, acceptable use policies, and operational guidelines, which you are solely responsible for reviewing and complying with.
- We do not control, endorse, or assume responsibility for third-party platforms, their policies, their enforcement actions, or their operational status.
- Third-party platforms may suspend, restrict, or terminate your access based on their own determinations, and such actions are entirely outside our control and responsibility.
- Your use of bulk messaging, broadcast campaigns, automated communications, or high-volume sending features may violate third-party platform policies, and you assume all risks and consequences of such use.
- We do not guarantee compatibility, availability, or continued integration with any third-party service, which may be modified or discontinued at any time.
